5. Product Availability
We use a stock inventory system to control when orders can be placed. As we also sell by other platforms, it is possible though unlikely, that you buy a product we don’t have in stock. If that happens, we will get in touch with you and offer a backorder, or give you a refund. If products are no longer unavailable (we cannot get it back in), it’s not Astro Dog’s responsibility, your order will simply be cancelled and you will be refunded. If there is a backorder, and the price goes up, we will still try and fulfill it as long as the price hike isn’t deemed unreasonable us by. If it is, we will simply refund you.
6. Ebay
To the extent allowable by law, products purchased from Ebay are bought and sold under Ebay trade policies, including return policies. and are not eligible for certain benefits afforded to customers who buy direct via the website, including the use of Astro Dog vouchers.

10. Ordering products, Online Security
Products displayed in the store constitute an invitation to treat, not an offer. Acceptance takes place when we confirm the order via email and change the status of the order to “processed”. Before this, while the order is “pending” the contract has not yet been accepted. This is important as at times, due to human error, a product may no longer be in stock, be damaged, or similar and it may be impossible to fulfil your order. Alternatively, special orders (orders for speciality, or expensive items that we do not normally keep in stock) are considered accepted once we have taken special action to secure your order, such as ordering your goods with a supplier, or you have paid a deposit via the lay-by option.
Orders can be placed online by means of the payment options provided (e.g. Poli, Stripe, Afterpay and Paypal systems. You can also arrange direct deposits, but these need to be done within 2 working days of placing your order. The payment should be your last name, or invoice number. You need to be over 18. Cases of people trying to mislead us or fake an identity will be reported to the Police. We don’t post goods until the payment clears.
We don’t personally keep or process credit card information ourselves, it’s all handled by our payment providers. We all rely on payment providers to make sure the transactions are safe and secure. In some cases, we may take an order over the phone and accept payment via Stripe, eWay or PayPal. Keep your device up to date security-wise please before placing an order with us, and that includes good firewalls, an up to date operating system etc… Not our fault if something goes wrong while ordering online from us.
11. Reviews
After you have placed an order, you consent to being sent an email from us (usually about a week later) requesting that you review your purchases. Completing a review is entirely optional and is no requirment to complete it. You can ‘opt out’ of receiving this in the first place, by putting “No reviews please” or similar in the checkout field during any purchase if you wish.
12. Privacy and Cookies
When you use our website, you agree to our “Privacy and Cookie Policy“. In many cases, these terms are passed on by plugins that are required for the website to operate (for example, the google ads plugin allows our products to be found online).
13. Responsible use of Products / Solar Safety
It is your responsibility to use the products from us safely and responsibly. Invisible wavelengths from the sun can damage the retina of the eye, and in extreme cases cause complete blindness. Do not take chances. Astronomy is a relatively benign hobby with few chances for serious injury (back injury, tripping etc.. not withstanding), but this is one of them. NEVER point your telescope at the sun. Do not leave a telescope unattended, where children might do this. Seek specialist advice before attempting any solar work. Don’t use welder’s filters. Never buy “solar filters” that go over the eyepiece, they are incredibly dangerous as they have been known to go “pop”, “crack” and then your blind. They are illegal in Australia anyway. You have been warned. Some equipment we sell is heavy, and needs to be moved by two people.
14. Breach of Terms
Without prejudice to Astro Dog’s other rights under these Terms of Use, if you breach these Terms of Use in any way, Astro Dog may take such action as Astro Dog deems appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your Internet service provider to request that they block your access to the website and/or bringing legal action against you. Failure to enforce any provision of these Terms of Use shall not constitute or be construed as a waiver of such provision or the right to enforce such provision.
15. Limitation of Liability
This website and all information, content, materials, and other services made available to you through the website are provided by Astro Dog on an “as is” basis. Astro Dog makes no representations or warranties of any kind, express or implied.
Astro Dog does not warrant that the website is free of viruses or other harmful components. Astro Dog will not be liable for any damages of any kind arising from the use of any service, or from any information, content, materials, or other services made available to you through the website, including, but not limited to direct, indirect, incidental, punitive, and consequential (including loss of profits) damages. You indemnify us to the fullest extent against any and all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these terms.
16. Law and Jurisdiction
These Terms of Use shall be governed by and construed according to the laws of the State of Queensland, Australia, without regard to conflict of laws provisions. Any legal action relating to these Terms of Use shall be brought in a court having jurisdiction in the State of Queensland, Australia.
